  • "Service" refers to the Nancy mobile application and website.
  • "You" refers to the individual accessing or using the Service.
  • "AI Companion" refers to the artificial intelligence system known as Nancy within our Service.

2. Acknowledgment

These are the Terms of Service governing the use of this Service and the agreement that operates between You and the Company. These Terms of Service set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms of Service. By accessing or using our Service, You agree to be bound by these Terms.

3. Age Requirements

You must be at least 18 years old to use our Service. While Nancy is designed to be accessible for seniors, users must be of legal age to enter into this agreement.

If You are using the Service on behalf of an elderly family member or loved one, You must have proper authorization and agree to be responsible for their use of the Service.

4. Proper Use of Service

Nancy is designed to provide emotional support and companionship through AI-powered conversations. You agree to use the Service responsibly and understand that:

  • Nancy is an AI companion and not a replacement for professional medical, psychological, or emergency services
  • In case of emergency, You should contact appropriate emergency services immediately
  • The Service is intended for companionship and emotional support, not medical advice
  • You will not attempt to misuse or exploit the AI system

5. Privacy and Data

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using the Service, You consent to the collection and use of information in accordance with our Privacy Policy.

Voice conversations with Nancy are processed to provide personalized responses but are not stored permanently unless You specifically consent to conversation history features.

6. Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach the Terms of Service.

Upon termination, Your right to use the Service will cease immediately. You may also terminate Your account at any time through the app settings.

7. Disclaimer of Warranties

The information on this Service is provided on an "as is" basis. To the fullest extent permitted by law, this Company:

  • Excludes all representations and warranties relating to this Service
  • Does not guarantee that the Service will meet Your specific requirements
  • Does not guarantee uninterrupted or error-free operation
  • Does not guarantee the accuracy or completeness of AI responses

8. Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven't purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company be liable for any special, incidental, indirect, or consequential damages whatsoever.

9. Governing Law

The laws of the United States, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

10. Changes to These Terms

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at Our sole discretion. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms.
